After nine days of testimony, an Allegany County jury returned a multi-million verdict in favor of the plaintiff. The case involved a birth injury that occurred five years ago. The case was particularly complex because it involved a rare congenital heart condition known as coarctation of the aorta.
The crux of the case concerned whether the treating physician breached the standard of care when he did not refer the child to a pediatric cardiologist. Madison Henry, now 5 years old, is severely brain damaged caused by her heart stopping and a lack of oxygen to the brain.
