Birth Injury Results in Wrongful Death Lawsuit

A medical malpractice lawsuit has been filed by parents of a baby who died as a result of injuries sustained during childbirth.

The birth injury lawsuit alleges that the forceps used during the delivery process caused severe head trauma resulting in wrongful death.  The attending obstetrician and the University of Colorado Health Memorial Hospital North were named as defendants in the malpractice lawsuit.

The lawsuit alleges that the parents were never informed that delivery by Caesarian section was a viable option as well as the obstetrician's failure to properly evaluate the baby, failure to perform a proper delivery, and failure to transfer the baby to an adequate NICU to evaluate his medical condition.

These allegations are also brought against the hospital in question alleging that the institution is vicariously liable for the actions of its employee, the obstetrician.
